These Terms of Use apply to your access to and use of the SnapView Virtual Office Website (“VOW”) through which Multiple Listing Service® data of the Greater Vancouver REALTORS®(“GVR”) is displayed. They are the same Terms of Use that you accepted, or will be required to accept, at registration.
These Terms of Use (the "Terms") govern your access to and use of the Virtual Office Website ("VOW") operated by the SnapView VOW Participant (the "Participant") through which Multiple Listing Service® ("MLS®") data of the Greater Vancouver REALTORS® ("GVR") is displayed. By clicking "I Accept" you confirm that you have read these Terms and agree to be bound by them in full.
Subject to your continuing compliance with these Terms, the Participant grants you a personal, revocable, non-exclusive, non-transferable, non-sublicensable, limited licence to access the VOW and to view the MLS® content displayed on it solely for your personal, non-commercial use in connection with the consideration of the purchase or lease of a residential property.
Access to this VOW is restricted to consumers who have a bona fide interest in the purchase, sale or lease of real estate of the type displayed on the VOW. You confirm that you are entering into the relationship for that purpose, that the information you submit in connection with your registration is true and that you are not requesting access on behalf of any other person who has not separately registered.
You acknowledge that the Participant is acting as your REALTOR® for the purpose of providing access to the MLS® content on this VOW and that the relationship between you and the Participant is a lawful real-estate brokerage relationship in accordance with the Real Estate Services Act (British Columbia) and the rules of GVR.
The MLS® content made available to you through this VOW is provided to you solely for the purpose described in section 1. You may display, print and retain a single copy of any listing for your personal review.
Except as expressly permitted in the preceding paragraph, you must not, and must not authorize or permit any other person to: (a) copy, redistribute, retransmit, frame, mirror, scrape, harvest, index, cache, store, modify or create derivative works from any MLS® content; (b) display, publish or make any MLS® content available to any other person, whether on a public or private website, in print, by email, or by any other means; or (c) use any robot, spider, automated process, screen-scraping tool, or other manual or automated mechanism to access, monitor or copy any portion of the VOW or its MLS® content.
You acknowledge and agree that all MLS® content displayed on this VOW is the property of GVR and the members of GVR who have submitted that content to the MLS® system, and is made available to you under the GVR rules governing virtual office websites. Nothing in these Terms transfers to you any right, title or interest in the MLS® content or in the trademarks "MLS®", "Multiple Listing Service®" or "REALTOR®", which are owned by the Canadian Real Estate Association or its licensors.
You acknowledge that the MLS® content is dynamic and may be updated, corrected or withdrawn at any time without notice, and that the Participant has no obligation to retain or preserve any listing once it ceases to be available through the MLS® system.
The VOW Participant operating this site, and the entity providing the limited licence described in these Terms, is the SnapView VOW Participant on file with GVR. The current Participant details — including the registered brokerage, licensed managing broker and contact information — are published at the foot of this page and are updated when GVR records change.
The Participant may from time to time revise these Terms in order to comply with the GVR rules or with the Real Estate Services Act (British Columbia). When the Terms are updated, you will be required to review and re-accept the revised Terms before continuing to use the VOW. Continuing to access the VOW after a revision becomes effective, without completing the re-acceptance, is not permitted.
GVR rules require the Participant to be able to demonstrate that each registrant has accepted the version of the Terms in force at the time of acceptance. The Participant therefore records the date and time of your acceptance and the version of the Terms that you accepted; that record is maintained for the period required by the GVR rules.
The Participant may suspend or terminate your access to this VOW at any time, with or without notice, if the Participant reasonably believes that you have breached these Terms, that you no longer have a bona fide interest in the purchase, sale or lease of real estate of the type displayed on the VOW, or that your continued access would place the Participant in breach of the GVR rules. Termination of your access does not relieve you of any obligations under these Terms that by their nature survive termination.
The MLS® content is provided on an "as is" and "as available" basis. The Participant, GVR and the members of GVR do not warrant the accuracy, completeness or currency of any MLS® content. You should verify any information that is material to your decision directly with the listing brokerage or by independent inspection. To the maximum extent permitted by law, neither the Participant nor GVR is liable for any direct, indirect, incidental, consequential or punitive loss arising out of your use of, or inability to use, this VOW.
You agree to indemnify and hold harmless the Participant, GVR and the members of GVR from and against any claim, loss, liability or expense arising out of your breach of these Terms or your use of any MLS® content otherwise than as permitted by these Terms.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province. You and the Participant submit to the exclusive jurisdiction of the courts of British Columbia in respect of any dispute arising out of or in connection with these Terms.
